Federal Renewable Portfolio Standard (Sec. 402). The federal Renewable Portfolio Standard (RPS) would require all retail electric suppliers to ensure that at least part of their power (7.5% of 2010) is produced from renewable energy sources--solar, wind, geothermal, or biomass. Retail suppliers would demonstrate their compliance by submitting renewable energy credits to the Secretary. Retail suppliers would receive renewable energy credit for each kilowatt-hour of electricity generated from renewable resources. Credits could also be purchased from the Secretary or sold among retailers. There will be a strong market for credits. Retail suppliers (including Tribes) would receive two credits for each kilowatt-hour of renewable energy generated on Indian lands. This will provide a strong incentive for the development of renewable power on Indian lands.
The Public Benefits Fund (Sec. 401). The Public Benefits Fund would support public purpose programs that increase the availability of affordable electricity to low-income customers, implement energy conservation and energy efficiency measures, and support emerging technologies, and provide for rural assistance if necessary. The Fund would be governed by a seven-member Joint Board which would include a Native American. Tribal governments that establish public purpose programs may apply for payments from the Fund to cover up to 50% of the cost of those programs.
Tribal Electricity Assistance (Sec. 407). The bill would create a tribal electricity assistance program that would provide $5 million a year for seven years to Tribes in technical assistance and grants for the study of tribal electricity needs, transmission improvement opportunities, and the effects of deregulation. The program would also provide up to $15 million a year for the planning, improvement, or construction of tribal generation, transmission, and distribution facilities.
Office of Indian Energy Policy and Programs (Sec. 408). The bill would create an Office of Indian Energy Policy and Programs. The Office would coordinate and implement tribal energy efficiency promotion, modernize tribal electric infrastructure, promote tribal sovereignty and self-determination related to energy matters, lower or stabilize electricity rates, and electrify tribal homes.
